IMPLEMENTATION OF CENTERS FOR THE MEDIATION AND SOLUTION OF CONFLICTS IN VENEZUELA

ABSTRACT
It is important to highlight that the inclusion of the Alternate Means of Solution of Conflicts in the Venezuelan Constitution of the Bolivarian Republic of Venezuela of 1999, in its article 258 establishes that:"The Law shall promote the arbitration, conciliation, mediation and any other alternate means for the solution of conflicts”. In the same way, in the article 253 we find: "The judiciary system is constituted by ... the alternate means"; in other words, from that moment, the valuable MARCS obtain the constitutional character, which confront a true change of paradigm. This present proposal and consideration is a product of distinct doctrines and regulations in force in Latin America, and it translates into an initiative, at national levels of the Centers for the Mediation and Solution of Conflicts as a real alternative within the Venezuelan society in order to ease the functioning of the ordinary courts of justice and to guaranty the culture of peace. Of all the above exposed, the mere fact that the Alternate Means for the Solution of Conflicts have constitutional character and, these, at the same time, have already been incorporated to distinct legal texts, constitutes a great advance in these matters in our country. If in legal matters we might be observe advances such as the judiciary mediation process which has fortified even more the MARCS in our country, the beginning and practice of the institutional inclusion of mediation in Venezuela would provide the leading aspects of Mediation and Solution of Conflicts. Therefore, which would the advantages of the creation of these centers be? It might be said that a series of benefits exist, but it is a pity that they have been poorly diffused. It is important to emphasize that with the implementation of the Centers for the Mediation and Solution of Conflicts a procedural solution is procured for the problem confronted by the parties involved, and facing the very long and very expensive judiciary processes; it will make possible a change in the mentality of the Venezuelans, thus, it will lead to the institutionalization of mediation. As an ultimate instance, mediation constitutes a mechanism that propels social peace as it reduces to tolerable levels the procedural loads of the Venezuelan State including all the dissatisfaction experienced by the citizens because of the traditional services, providing a satisfactory solution of the controversies for the leading parties in the process, and favoring the communicative practices that ease understanding and dialogues as well.
